The Promoter
The promoter is: TAP IN MEDIA LIMITED (company number: 11044802) of Peter House, Oxford Street, Manchester, England, M1 5AN.
The prize draw
The title of the prize draw is REFER A FRIEND CASH PRIZE DRAW.
The prize draw is being launched and promoted via email marketing from “hello@wearetapin.com”. The email account “hello@wearetapin.com” is wholly owned and managed by the Promoter.
How to enter
The prize draw will run from [15:00] on [19.06.2023] (the "Opening Date") to [23:59] on [11.7.2023] (the "Closing Date") inclusive.
All prize draw entries must be received by the Promoter via the method set out at paragraph 3.3 below by no later than [23:59] on the Closing Date. All prize draw entries received after the Closing Date are automatically disqualified.
To enter the prize draw, you (the “entrant”) must direct one or more friend (the “referee”) to complete the This Is Black Gen Z Survey in full: [https://tally.so/r/w7XGXP] and the referee must identify your full name and email address in response to the final question of their survey submission.
You will therefore be counted as having one entry for each referee who:
fills out the survey in full; and
identifies your full name and email address at the final question of their survey submission (to indicate that you had referred them).
There is no maximum limit of entries so the more referees you successfully refer, the more entries you will have in the prize draw.
No purchase is necessary to enter the prize draw and there are no other charges payable in order to enter the prize draw. VOID WHERE PROHIBITED.
The Promoter will not accept:
responsibility for prize draw entries that are lost or delayed in transmission, regardless of cause, including, for example, as a result of any internet failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
proof of transmission as proof of receipt of entry to the prize draw.
By submitting a prize draw entry in accordance with paragraph 3.3 above, you are agreeing to be bound by these terms and conditions.
The prize draw entries will be entered into a spreadsheet and the winner of the prize draw will be randomly selected, in accordance with the rules of the prize draw, using a randomised generator tool.
Eligibility
Entry into the prize draw is open to all residents in the UK (including international students) except:
employees of the Promoter or its holding or subsidiary companies;
employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or
members of the immediate families or households of (a) and (b) above.
In entering the prize draw, you confirm that you and your referee(s) are eligible to do so and eligible to claim the prize in the event that you win. The Promoter may require you (and your referee(s)) to provide proof that you (and your referee(s)) are eligible to enter the prize draw.
Those under the age of 18 may only enter the Prize Draw having obtained consent from their parent(s) or legal guardian(s) before entering.
The Promoter reserves all rights to disqualify you if you or your referee(s) conduct is contrary to the spirit or intention of the prize draw.
The prize
The prize for the winning entry will be:
100 GBP, payable in cash to the entrant; and
100 GBP, payable in cash to the referee to which the winning entry relates.
The prize draw is not affiliated with, endorsed, or sponsored by the employer partners supporting the This Is Black Gen-Z Research project, as outlined on thisisblackgenz.com (the “Event Sponsors”).The prize is not negotiable or transferable. There is no alternative for the prize.
Winners
Once ascertained, the winner and the winning referee will each be contacted by the Promoter via Email (hello@wearetapin.com) informing each of them that they have been selected as the winner (the “Win Notification”).
In order for each of the winner and the winning referee to claim the prize, the winner and the winning referee must each respond to the Win Notification (via email) within 7 days of receiving the Win Notification and include their preferred email address in their response.
If one of either the winner or the winning referee fail to respond within 7 days of the Win Notification but the other person (being the winner or the winning referee) does respond within 7 days then the person who has responded in time will provided with both parties’ full cash prize (i.e. GBP 200).
If both the winner and the winning referee fail to respond within 7 days of the Win Notification the prize will be forfeited and the selection process will be re-done in order to randomly select a new winner and winning referee. Forfeitures will continue to occur until the prize has been claimed by the applicable winner.
The decision of the Promoter is final and no correspondence or discussion will be entered into.
Once the Promoter has received the email address from the winner and/or the winning referee it will, within three days, contact the winner and/or winning referee via email to inform the winner and/or the winning referee of the next steps in the process for claiming the prize and arranging payment (the “Payment Email”). The winner and/or the winning referee must respond via email to the Payment Email within three days of receipt and include in their response, the winner’s and/or the winning referee’s (as applicable):
Full name;
Residential address;
Photographic ID (e.g. passport or driving licence);
A letter or utility bill dated within the preceding three months to evidence the home address of the winner; and
Bank details for the prize to be transferred to.
The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of the winner and/or the winning referee within 10 working days of the Closing Date (the “Announcement Date”).
If the winner and/or the winning referee objects to either or both of their surname or county being published or made available, please contact the Promoter by emailing hello@wearetapin.com. In such circumstances, the Promoter must still provide the information and evidence of the winning entry to the Advertising Standards Authority on request.
Claiming the prize
The prize must be claimed in accordance with paragraph 6. If the winner and/or the winning referee does not claim the prize by this date, their claim will become invalid and the prize will be forfeited and re-allocated as set out in paragraphs 6.3 and 6.4.
The prize may not be claimed by a third party on the winner’s and/or the winning referee’s behalf.
The Promoter does not accept any responsibility if the winner and/or the winning referee is not able to claim the prize.
Limitation of liability
To the maximum extent permitted by law, the Promoter, its agents or distributors as well as the Prize Sponsor exclude all liability and responsibility for any amount or kind of loss or damage that may result to a participant or a third party (including, without limitation, any direct, indirect, punitive or consequential loss or damage or any loss of income, profits, goodwill or use) arising from or connected in any way (whether in tort, negligence, breach of contract or otherwise) in connection with the prize draw and/or the prize and will not in any circumstances be responsible or liable to compensate the winner and/or winning referee or accept any liability for any loss, damage, personal injury or death occurring as a result of claiming the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
Ownership of prize draw entries and intellectual property rights
The Promoter does not claim any rights of ownership in your prize draw entry.
Data protection and publicity
The Promoter will process your personal information as set out in its Privacy Policy. See also paragraphs 6.7 and 6.8 above, with regard to the announcement of winners and winning referees.
General
If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.
The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.
These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
